However, if you were using a headset, and you had your treo in your pocket, it seems like having that hangup button might cause an accidental hangup if you bumped the phone...

So, this is what I'm thinking. Since you are already detecting whether or not the headset is plugged in (for the alarm sounds), why not use that information to enable/disable the ability to hangup with the hardkeys? You could just make it an option "Disable hangup button(s) with headset use"
