I'm just trying to make sense of this. What, if anything, can we gather from what happened and the files that Shadowmite saw? Is my post #1006 a correct assesment or not?

No idea Perry. All I can tell you is I grew up in Iowa and if you saw manure on the ground and saw a the field was filled with cows it was pretty evident it was cow manure. This is starting to look like another false alarm. Amazingly the link between Merlyn and Slinky is starting to make me wonder if this is not some concerted effort. Ifind it interesting that Slinky claimed that his "farce" caused Palm to leak the now infamous Merlyn picture. Merlyn claims he bought the phone off craigslist but is now apparently scared to talk about it. Shadow says only that the device Merlyn claims to have may share some files with a device referred to as Low-Rider and not that he in fact has a Low-Rider. I was under the impression from others here that Shadow himself had a 700p for review recently but that appears to have been a mistatement by others also. The timing on this just stinks. Wait, we are back to the cow manure point again aren't we.
I still stick to the information IT Week published saing the current POS can not be used with some of the new features the carriers are wanting so not to expect a new POS based phone till 2007. Why would I want to take the word of someone who claims to have bought a Treo 700p before it was released over the reported story in a publication like IT Week?
So my friend we are in the same boat. We seek the truth and to make sense of this all.

If it had FCC approval, wouldn't that info be public ? It was not legitimately sold through an authorized retail outlet. Kinda like saying if I got my hands on a stereo system that "fell off a truck", you couldn't be hassled for reselling it cause I sold it to you. It's called receipt of stolen property.
Joe Blow signs an NDA as a employee of some company in which he agrees, under threat of civil and criminal penalties, not to disclose any information nor give up the device. He then loses it or sells it to you.
The cops and / or lawyers then arrive at your doorstep demanding to know how and from whom you got the phone. They state that you were well aware that this was a preproduction model subject to NDA's , you even took the step of defacing (in the photos) the serial numbers which would identify the unit and the culprit. So I see several reasons why an individual might regret "going public" with such a device.

gharrod you are SUCH a doubting Thomas. I have always questioned your true motivations.
This is my take on this.
1.) Shadow saw a pre production version of 700p or Lowrider"
2.) Merlyn_3D has another pre-production version of the 700p OR Lowrider which pics were posted of
3.) Shadowmite has confrimed the authenticity of Merlyn_3D's device through various methods
4.) There are some "****ed" PALM, INc. folks out there that want to know how Merlyn_3D got this unit. (That is another question re: where this device came from)
The silly season is upon us and we will be seeing more info soon.

they cant hold merlyn to what was said on this thread
he has a right to free speech as long as he didnt sign an NDA
and if they were to go after anyone, it would be treo central and i doubt they would do that as it seems to be such a loyal fanbase

Ok, since Big Tex is the source of all knowledge and he thinks I am here for immoral reasons I will now sit back and read on and laugh at the absurd assertions by those who are here just to play mind games with you. Also, Big Tex when else have you stated your "questioning of my motives"?
No one has confirmed anything except now Merlyn is running scared from his earlier story. When Weebitobsessed came across with the Treo pictures he brought us there were literally dozens of them. Here we have bad photoshops and you call my integrity into question?
This is beyond silly. This is stupid and approaching moronic.
So now since Big Tex is the thought police and none other then he can question or comment why not just close the forums?

Seeing Sprint's commercial during the Super Bowl, if the new Treo has the "theft deterrent system" that is being advertised, can we call it "Low Jack" instead?

I can't blame Merlyn.. If I got my hands on one... You guys would have a full review the next day lol...
I don't know why Palm is being so secretive... If they would just make a statement about a new POS treo, it would calm a lot of people down... Look @ how many customers they lost to the 6700, I was almost one of them, and it was mainly due to thinking the Palm OS was dead...When companies start making deals with the devil(MS) it usually means the end is near.

By no means do I want to put the credibility of shadowmite in question, he's a great guy, and very helpful. The only other thing I'm going to say for now is that the unit I had is back in Palm's possession. I haven't been threatened with any legal action, nor do I want to be.

I wouldn't worry about it. I don't think any regular visitor to TC would question Shadow's credibility. Now that the unit is back in Palm's possession, I'm glad a few people got an opportunity to get a peek under the hood. In might be helpful to everyone in the future. Thanks for the peek, and to Shadow for fidgeting under the hood. It was an interesting weekend!
